TERMS & CONDITIONS

The following legalities and agreement contract effective is by and between Axis Video Productions (from here on referred as ‘AVP’) and the responsible party for professional videography and digital editing services acquired for the specified wedding event (specified on the booking form).

 

Agreement

This agreement is between AVP and the "Responsible Party" (Client) as designated on the details sheet. AVP agrees to provide videography services at the places, dates, and times specified in the "Booking Form" of this document. If, for any reason that obligation cannot be met, AVP will endeavour to rectify the problem or in extreme circumstances, organise a suitable substitute. The non-refundable deposit secures the dates and times for videography services.

Although the deposit is not refundable, if the wedding is postponed, it will remain as a 2-year credit toward a future date. Payment must be made in full before the delivery of the final product unless otherwise specified failure to pay outstanding balances may result in the inability to provide services and/or legal action. 

 

Wedding Videography

The cameramen will do his best to capture the day in a manner that is pleasing to the clients and adheres to a professional standard. AVP is not responsible for capturing video shots that are not requested. The cameramen are experienced and will, by default, seek to capture traditional and candid video shots (as well as time and circumstances allow). If the Responsible Party has certain angles, shots, or montages they wish captured, then they are required to inform AVP of the shots prior to the wedding day. Lighting is subject to venues and AVP will not

be held responsible for poor lighting at receptions and/or ceremony venues.

AVP staff are contracted by the client to undertake a maximum working day of 8 or 10 hours. This will be agreed at the time of booking and our staffs welfare is of upmost importance. We reserve the right to request that once the agreed time has been reached that the staff may leave. 

The time on site includes and is not limited to travel between multiple sites or the order of the day overrunning.

e.g. travel from church venue to reception venue or speeches last for 30mins more than agreed with the venue. 

 

Video Rights & Format

AVP maintains the right to use the video captured under this contract for advertising and portfolio use. This includes all commercial rights and use of video, imaging & audio including, but not limited to distribution of the video on the AVP website as a portfolio piece.

In signing this agreement you agree to give AVP permission to use these images, videos, and recordings, as well as your likeness, name, and voice, as follows:

• The use may include reproduction, distribution, derivative works, display, and performance.

• The use may be in composite or modified forms and in any media, now known or later developed, including without limitation newspapers, television, radio, the World Wide Web,

and social media.

• The use may be for any purpose throughout the world and in perpetuity, including, without limitation, education, trade, advertising, and promotion.

• AVP staff will make an attempt when appropriate and where they see fit to take a photograph throughout the day, but these remain the property of AVP (see additional information at the bottom of this contract).

This also includes any guests of the event/wedding to be used in the above.

 

Sole Videographer

The client will actively work to help the cameramen provide professional footage by ensuring that amateur photographers and videographers do not hinder or pose as an obstacle whilst shooting. If important shots are impaired by guests (i.e. Bridal ceremonial entry) AVP will not be held responsible. Please note however that AVP will endeavour to politely request that guests reallocate if impairing the view.

 

Receiving Finished Product

The client will usually receive their video within 12 weeks of the wedding date. It is compulsory that sufficient time and effort is applied to the raw footage to achieve the level of professionalism AVP offers. A copy of the final project will be stored on site and usually will be available if additional copies are needed. However, we do not guarantee that your video will always be available. You will be able to take ownership of your films by saving the files locally or storing them on a USB hard drive. The Client can purchase as many copies of their films from AVP on USB at any time in the future. The final video will be delivered online via WeTransfer. AVP will not be held responsible if your internet downloads this slowly or your Smart TV device/Computer is not compatible with the standard file format we use.

 

Re-Edits

If for any reason the client strongly requests a re-edit of any section of the main feature or highlights, it will be considered by AVP only if negligence or any accidental mistakes arises where AVP is solely at fault. If this uncommon situation occurs, the re-edits will be completed free of charge. Any other re-edits will be billed at a rate of £49 per hour for time involved.

Customers Duties.

We kindly request that our staff are provided with food and soft drinks for the duration of the days filming. Please discuss with us further if this is something you are unable to accommodate.

 

Limited Liability

AVP liability is limited to fulfilling this agreement or to return all deposits made by the Client. AVP will take the utmost care to produce a professional and enjoyable wedding film. However, AVP will not be held responsible for circumstances beyond their control, including but not limited to power failure, equipment malfunction, defective flash cards stock or cliental responsible parties’ misuse of equipment. If filming is prevented due to such occurrences, all money paid will be considered and a possible refund (deposit excluded) may occur. A product, if

available, will be significantly discounted. Other rare but unfortunate circumstances that may occur where AVP Videos will not be held responsible to fulfil this contract include:

• Lateness due to unforeseen traffic conditions / involvement in road accident / vehicle break down or delayed flights

• Theft or destruction of equipment/media

• Equipment malfunction including backup equipment malfunction

• Wedding guests impairing or hindering the filming

• Photographer impairing or hindering the filming

• AVP employee illness/injury

 

Guests Liability on Equipment

Videography equipment is very expensive and will be monitored at all times on the wedding day. However, in the event of equipment damage due to children or drunk & disorderly guests, repair costs will be forwarded to the responsible parties when insurance cover is not applicable.

 

Weather Conditions

AVP will not be held responsible for quality of footage when weather conditions do not permit equipment to be utilised to its full potential i.e. rain, downpour, high winds, thunderstorms or extreme heat. However, the cameramen will endeavour to maintain quality of footage whilst making sure equipment is not damaged as a result.

 

Punctuality

Both the Cameramen and Client are expected to be on time and ready for video shooting according to the times stated above. If the client or anyone from their party is late, the time the Cameramen spends waiting will still be counted towards the time agreed upon in this contract. If the Cameraman is late, the time the client spends waiting for the Videographer is NOT counted toward the time agreed to in this contract, and the Videographer is obligated to fulfil the full amount of time agreed to in this document.

 

Cancellation

The client may cancel this contract at any time by giving written notice to AVP but in doing so shall forfeit any monies paid. Should cancellation be received by the videographer’s less than 30 days prior to the date of the ceremony, the client shall pay an additional amount so that the total paid by the client is equal to 75% of the contract value. Should cancellation be received by the videographer’s less than 14 days prior to the date of the ceremony, the client shall pay an additional amount so that the total paid by the client is equal to 100% of the contract value.

 

GDPR

The Client agrees that any personal information submitted to AVP will be used for the above purposes mentioned and will be stored safely on a password protected portable hard drive on site at the AVP operating premises.

The above information will be stored indefinitely along with all of the footage files in case the client ever requires changes and/or additional copies.

By signing this agreement, you Opt in to having your personal information submitted and stored securely by AVP.

If at any point you would like your personal information removed from our database then you would need to submit this in writing to the following email address: axisvideoproductions@gmail.com and detail that you wish to be forgotten and all personal data removed from our database.

Additional Information

AVP staff will attempt to take photos throughout the day for marketing purposes only, We are hired purely for the purposes of documenting video only. Any Photos taken throughout the day will NOT be issued to The Client under our standard terms of business, however if The Client would like copies of the photos then they will be chargeable at a fair price to be negotiated between The Client & AVP.

 

Payment Terms

AVP will arrange an Invoice to be sent to the email address provided by the client & the client is responsible to pay a 30% deposit on receipt on the invoice to ensure the requested date is booked and secured.

The balance shall be paid no less than 2 weeks prior to the agreed date.

Axis Video Productions reserves the right to change & alter this contract without giving notice to any clients past or present.
